Remainder Interest in Supplemental Needs Trust
New York Appellate Division, Second Department, holds that the remainder interest in a supplemental needs trust, drafted in conformity with statute, is as of the date of the creation of the supplemental needs trust, deemed to have been created as of the date of the order directing the creation of the trust.  In re Ruben N., decided on September 16, 2008.  The Court reversed as a result of Abraham XX.
